Merchant Agreement

1. Definition and Scope

This "Merchant Agreement" governs your use of the storefront services provided by Ecommaps. By opening a store, you represent and warrant that you are operating a legitimate business entity and have the legal authority to enter into this agreement on behalf of yourself or the entity you represent.

2. Know Your Customer (KYC) & Activation

To activate full store features, specifically to integrate online payment gateways (CIB / Edahabia), you must provide the following documents for business verification:

  • Commercial Registry (RC): A valid copy.
  • Tax Identification Number (NIF): The tax identification card.
  • Identity Document: A copy of the National ID of the store owner or legal manager.

Note: Ecommaps reserves the right to suspend any store that fails to provide these documents or is found to have submitted forged documents, reporting to authorities if necessary.

3. Responsibility for Products and Content

As the Merchant, you are solely and exclusively responsible for:

  1. Product Legality: Ensuring all listed products are legal to sell under Algerian law.
  2. Product Description: Providing accurate descriptions, real images, and transparent pricing (including applicable taxes).
  3. Intellectual Property: Ensuring that content (images, text, trademarks) does not infringe upon the rights of others.

4. Payments and Fees

  • Platform Fees: The Merchant agrees to pay their subscription fees to Ecommaps on time to ensure service continuity.
  • Merchant Sales: Ecommaps is not a "bank." Funds paid by your customers via online payment go directly to your commercial bank account (via the payment gateway) or collected via Cash on Delivery. We do not hold your sales revenue.

5. Taxes and Invoicing

You (the Merchant) are responsible for:

  • Determining applicable taxes on your sales (TVA, TAP).
  • Issuing legal invoices to your customers upon request.
  • Declaring your income to tax authorities. Ecommaps explicitly disclaims any liability for tax evasion committed by the Merchant.

6. Customer Service and Disputes

  • Technical Support: Ecommaps is responsible for technical support regarding your "Dashboard" only.
  • Customer Disputes: You are responsible for handling your customers' complaints, return requests, and delivery issues. Ecommaps does not intervene in commercial disputes between the Merchant and the Consumer unless fraud is proven.

7. Termination

You may close your store at any time. Ecommaps reserves the right to terminate this agreement and shut down the store immediately if:

  • The Acceptable Use Policy is violated (selling prohibited items).
  • Subscription fees are not paid.
  • The store is used for fraudulent purposes.
